Terms of Service

These Terms of Service (“Terms”) govern your access to and use of the PageCraft website at pagecraft.ca and the PageCraft platform (collectively, the “Service”), operated by PageCraft (“we”, “our”, or “us”). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

1. Eligibility

You must be at least 16 years old to use the Service. By using the Service, you represent and warrant that you meet this requirement and that you have the legal capacity to enter into a binding agreement. If you are using the Service on behalf of an organisation, you represent that you have authority to bind that organisation to these Terms.

2. Accounts

  • You must provide accurate and complete information when creating an account and keep it up to date.
  • You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account.
  • You must notify us immediately at hello@pagecraft.ca if you suspect unauthorised access to your account.
  • We reserve the right to suspend or terminate accounts that violate these Terms or that have been inactive for an extended period.

3. Description of Service

PageCraft is a blog publishing and content management platform that allows individuals and teams to create, manage, and publish blog content on their own websites. Features include AI-assisted writing, team collaboration, website integration via embed scripts, content scheduling, and analytics. The specific features available to you depend on your subscription plan.

4. Acceptable Use

You agree not to use the Service to:

  • Violate any applicable law or regulation.
  • Infringe the intellectual property rights of others.
  • Publish, transmit, or distribute content that is unlawful, defamatory, obscene, harassing, threatening, or otherwise objectionable.
  • Send spam, unsolicited messages, or engage in phishing.
  • Attempt to gain unauthorised access to any part of the Service or its related systems.
  • Reverse engineer, decompile, or disassemble any part of the Service.
  • Use automated tools (bots, scrapers, crawlers) to access the Service in a manner that exceeds normal usage or places undue load on our infrastructure.
  • Resell or sublicense access to the Service without our prior written consent.

We reserve the right to remove any content and suspend or terminate any account that violates these guidelines, without prior notice.

5. Intellectual Property

5.1 Our Property

The Service, including its design, code, trademarks, logos, and all content created by PageCraft, is owned by us and protected by applicable intellectual property laws. You may not copy, modify, distribute, or create derivative works without our express written permission.

5.2 Your Content

You retain ownership of all content you create and publish through the Service (“User Content”). By uploading or publishing User Content, you grant PageCraft a non-exclusive, worldwide, royalty-free licence to host, store, display, and deliver your content solely for the purpose of operating and improving the Service. We will never sell your content or use it for advertising without your consent.

6. Subscription Plans & Billing

  • PageCraft offers free and paid subscription plans. Paid plans are billed monthly or annually as selected at checkout.
  • All payments are processed by Stripe. By subscribing to a paid plan, you authorise us to charge your payment method on a recurring basis.
  • Plan upgrades take effect immediately. Downgrades take effect at the end of the current billing period.
  • Fees are non-refundable except as required by applicable law or as expressly stated in these Terms.
  • If a payment fails, we will notify you and may suspend access to paid features until payment is resolved.
  • We reserve the right to change pricing with at least 30 days' notice. Continued use after the effective date constitutes acceptance of the new pricing.

7. Free Plan & Plan Limits

The Free plan is available indefinitely but subject to usage limits (posts, websites, team members, and monthly page views). If you exceed your plan's limits, you will be prompted to upgrade. Existing content is never deleted solely due to exceeding limits, but you may be unable to create new content until you upgrade or remove items to stay within limits.

8. Cancellation & Termination

  • You may cancel your subscription at any time from your account settings. Cancellation takes effect at the end of the current billing period.
  • You may delete your account at any time. Upon deletion, your data will be removed within 30 days, subject to our data retention obligations.
  • We may suspend or terminate your account immediately if you breach these Terms, engage in fraudulent activity, or if required by law.
  • Upon termination, your right to use the Service ceases immediately. Sections of these Terms that by their nature should survive termination will do so.

9. Third-Party Services

The Service integrates with third-party services (e.g., Stripe, AI providers, cloud storage). Your use of those services is subject to their respective terms and privacy policies. We are not responsible for the availability, accuracy, or conduct of third-party services.

10. Disclaimers

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, PAGECRAFT AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY TO YOU FOR ANY CLAIM ARISING FROM THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE 12 MONTHS PRECEDING THE CLAIM.

12. Indemnification

You agree to indemnify, defend, and hold harmless PageCraft and its affiliates, officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or in any way connected with your access to or use of the Service, your User Content, or your violation of these Terms.

13. Governing Law & Dispute Resolution

These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to conflict of law principles. Any dispute arising from these Terms or the Service shall be resolved exclusively in the courts located in Ontario, Canada, and you consent to the personal jurisdiction of such courts.

14. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes by email or by posting a notice on the Service at least 14 days before the changes take effect. Your continued use of the Service after the effective date constitutes your acceptance of the revised Terms.

15. Miscellaneous

  • Entire agreement: These Terms, together with our Privacy Policy and Cookie Policy, constitute the entire agreement between you and PageCraft regarding the Service.
  • Severability: If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
  • Waiver: Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.
  • Assignment: You may not assign your rights under these Terms without our prior written consent. We may assign our rights without restriction.
