These Terms of Service (“Terms”) govern your access to and use of the PageCraft website at pagecraft.ca and the PageCraft platform (collectively, the “Service”), operated by PageCraft (“we”, “our”, or “us”). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.
You must be at least 16 years old to use the Service. By using the Service, you represent and warrant that you meet this requirement and that you have the legal capacity to enter into a binding agreement. If you are using the Service on behalf of an organisation, you represent that you have authority to bind that organisation to these Terms.
PageCraft is a blog publishing and content management platform that allows individuals and teams to create, manage, and publish blog content on their own websites. Features include AI-assisted writing, team collaboration, website integration via embed scripts, content scheduling, and analytics. The specific features available to you depend on your subscription plan.
You agree not to use the Service to:
We reserve the right to remove any content and suspend or terminate any account that violates these guidelines, without prior notice.
The Service, including its design, code, trademarks, logos, and all content created by PageCraft, is owned by us and protected by applicable intellectual property laws. You may not copy, modify, distribute, or create derivative works without our express written permission.
You retain ownership of all content you create and publish through the Service (“User Content”). By uploading or publishing User Content, you grant PageCraft a non-exclusive, worldwide, royalty-free licence to host, store, display, and deliver your content solely for the purpose of operating and improving the Service. We will never sell your content or use it for advertising without your consent.
The Free plan is available indefinitely but subject to usage limits (posts, websites, team members, and monthly page views). If you exceed your plan's limits, you will be prompted to upgrade. Existing content is never deleted solely due to exceeding limits, but you may be unable to create new content until you upgrade or remove items to stay within limits.
The Service integrates with third-party services (e.g., Stripe, AI providers, cloud storage). Your use of those services is subject to their respective terms and privacy policies. We are not responsible for the availability, accuracy, or conduct of third-party services.
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, PAGECRAFT AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY TO YOU FOR ANY CLAIM ARISING FROM THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE 12 MONTHS PRECEDING THE CLAIM.
You agree to indemnify, defend, and hold harmless PageCraft and its affiliates, officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or in any way connected with your access to or use of the Service, your User Content, or your violation of these Terms.
These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to conflict of law principles. Any dispute arising from these Terms or the Service shall be resolved exclusively in the courts located in Ontario, Canada, and you consent to the personal jurisdiction of such courts.
We may update these Terms from time to time. We will notify you of material changes by email or by posting a notice on the Service at least 14 days before the changes take effect. Your continued use of the Service after the effective date constitutes your acceptance of the revised Terms.
